Moonglow Laws
  1. Dealing with magic

    1. No person may use or attempt to use hostile magic against another induviual, unless absolutely necessary as an act of self-defence or to defend another individual.

    2. No person may use or attempt to use necromancy in the Moonglow area, unless they have been given special clearance from the council.

  2. Handling with pets

    1. No person may take or attempt to take any animal that is considerd to be hostile in the wild into the city other than with the intention to stable or remove from stabling that pet at the stable masters at the Scholar's Inn via "Anon Avenue". Duelling with such animal's may only take place in the public Moonglow training hall. Special license may be acuired from the council (if they can assure that the animal won't turn hostile) to be able to legally handle the animal's within the city gates.

  3. Crimes Assault

    1. No person shall act with violence against another individual, unless it is absolutely necessary as an act of self-defence or to defend another individual.

    2. An act of violence against another individual's pet may also be considered grounds for prosecution.

  4. Murder

    1. No person shall end or attempt to end another individuals life with an act of unprovoked violence following inferiour motives

  5. Kidnapping

    1. No person shall restrain another individual without their consent, unless to protect themselves or other individuals.

  6. Theft

    1. No person shall take or attempt to take any equipment or item from another individual without their consent, unless as part of a criminal investigation or to disarm them to protect oneself or others.

  7. Handling Stolen Goods

    1. No person shall buy or sell items which are known to them to be stolen goods, (such items or equipment that has been taken illegally from another individual).

  8. Dealing in Illegal Goods

    1. No person shall handle or deal with illegal goods (such goods are proscribed in the posted trading laws). It is the responsibility of every citizen to keep him or herself informed of the trading laws.

  9. Smuggling

    1. No person shall bring or attempt to bring into the Moonglow area any illegal goods, or legal goods in such a manner as to avoid the payment of taxes.

  10. Blackmail

    1. No person shall attempt to hold anything against another individual in a way to extract favour or money.

  11. Extortion

    1. No person shall attempt to use threats or force against another individual to extract favour or money.

  12. Bribery

    1. No person may offer money, gifts or favours to any individual holding legal authority in the city, for their own or another's benefit.

  13. Preventing the Course of Justice

    1. No person shall attempt to use falsehood or slander to effect a criminal investigation or trial.

  14. Slander

    1. No person shall knowingly and wilfully spread falsehoods in speech or writing about another individual which are intended to defame, discredit, or damage that individual or individuals associated with them in any way.

  15. Breach of the peace

    1. To increase the safety of the streets, no duelling is to take place in the Moonglow area except in a public training hall. The Moonglow guards are likewise not permitted to duel whilst on duty. This shall apply also to training pets to fight.

    2. Further to assist in keeping the peace, no person shall draw or openly bear arms within the Moonglow area unless specifically authorised to do so. Those authorised to bear arms in cases of need are the Moonglow Constable and the Moonglow guards. All other persons may possess arms but are not permitted to carry them in their hands or use them save in self-defence. An exception may be made in the case of the elderly or infirm who require a staff for support.

  16. Unlawful Imprisonment

    1. No person shall seek to confine within a jail or cell another individual on the basis of any alleged crime not here listed.

  17. Treason

    1. No person shall conspire, alone or in league with others, or actively take action, to damage, defame, discredit, remove or overthrow the rightful government of Moonglow, being the Moonglow Council.

Trial preparations and crime investigation
  1. Judicial Process

    1. All alleged perpetrators must be arrested in the Moonglow area, as we have no jurisdiction outside of the Moonglow area. Arrests can only be made in other cities or provinces with the agreement of the local authorities. If there are no authorities that are recognised by the Moonglow Council it will revert to the closest authorities.

    2. All prisoners are held for at least a two week period, this gives the appropriate authorities sufficient time to collect any evidence that would be needed for a trial. If no evidence is found 'at all' then the prisoner must be released pending a mistrial. If evidence is found, even if it is dubious or eventually does not class as evidence for a trial, the two week time period will reset while the authorities continue to collect evidence of the crime.

    3. If evidence is found within this two week period, the prisoners incarceration extends and they will then be awaiting a trial, they should inform the individual before releasing them on bail (bail shall be granted unless the person is deemed a danger to society (by nature of the crime) or is considered to require or requests protective custody), then file a report on one or more of the guild boards of the Moonglow Council listing the charges and details, along with the contact information and guild (if any) of the suspect.

    4. Upon reading the report, the Town Constable, elected to the position by the Council, will investigate the charges on the basis of the report and question further any individuals they deem fit. Within the period of one week of being assigned the case, they will decide and announce either a Settlement of the case with their decision and punishment (if any), or will put the case to Trial. If the suspect is unhappy with the Settlement, they may appeal to the Council. A Judge will be apointed by the Council before the trial takes place.

    5. If a Trial is necessary, the Judge will set a venue, date and time for a Court to be convened which is announced widely and is acceptable for the defendant to attend. The Justiciar is a appointed Prosecutor in a trial, the acting Judge will request that the defendant choose an Advocate to act on their behalf. The defendant may also choose to defend themselves, or ask the Judge to appoint an Advocate for them.

    6. The Prosecutor (Justiciar) and Advocate will then be responsible for questioning any witnesses they deem fit, and must arrange for these witnesses to be present at the Court to give testimony. A written witness statement will be acceptable if cross examination is deemed unnecessary.

    7. The acting Judge may convene or adjourn the Court as they deem necessary for the fair presentation of both cases. Once both Prosecutor (Justiciar) and Advocate have called all of their chosen witnesses and summarised their case, the Judge will make a verdict on the basis of the available evidence.

  2. Sentencing

    1. If the Judge finds an offender Guilty in a trial, they must decide an appropriate Sentence that is in proportion to the extent and seriousness of the crime.

    2. At the Judge's discretion, they may sentence the offender to a period of Exile beyond the city walls of Moonglow, from no less than one hour to no more than one week. If the individual breaks their Exile before its completion, they may be attacked or otherwise removed from town by any guards present.

    3. At the Judge's discretion, they may sentence the offender to a period of imprisonment within the Moonglow Jail, from no less than one hour to no more than one week. If the individual escapes from imprisonment before the completion of their sentence, they may be attacked or otherwise removed from town by any guards present.

    4. At the Judge's discretion, they may sentence the offender to a period of Amends through community service in a manner they deem fit which is helpful and constructive to the citizens of Moonglow, for a period of no more than two weeks.

    5. At the Judge's discretion, they may sentence the offender to an Act of Denouncement, by which the Judge will publicly criticise and censure the individual for their crime.

    6. At the Judge's discretion, they may sentence the offender to an Act of Abjuration, by which the offender must publicly apologise for their crime and beseech any injured parties for their forgiveness, which they are required to give.

    7. At the Judge's discretion, they may sentence the offender to a Flogging in public by a nominated guard, of no more than ten lashes.

    8. At the Judge's discretion, they may sentence the offender to a Warning to correct their ways, and offer them useful and constructive advice to seek to lead a more Virtuous and lawful life.

    9. All persons shall have right of appeal against a sentence they consider unjust. Such appeals may be made to the Council.
